In light of the new provisions on personal data protection, including in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter „GDPR”), Wygoda Travel Sp. z o.o., with its registered office at Plac Bohaterów Getta 17/14, 30-547 Kraków (hereinafter „WYGODA TRAVEL”), presents the basic information regarding the personal data of Users (Customers) of Wygoda Travel:

1. The administrator of the personal data of Users (Customers) is WYGODA TRAVEL Sp. z o.o. (Administrator), with its registered office at Plac Bohaterów Getta 17/14, 30-547 Kraków.

2. WYGODA TRAVEL can be contacted in the following ways: electronically at the email address: rodo@wygodatravel.pl, or in writing at the address: WYGODA TRAVEL Sp. z o.o., Plac Bohaterów Getta 17/14, 30-547 Kraków.

3. The personal data of Customers are processed by WYGODA TRAVEL for the following purposes:

  • Conclusion and performance of the contract (legal basis: Article 6(1)(b) of the GDPR).
  • Fulfillment of obligations incumbent on WYGODA TRAVEL under the law, in particular the Act on Tourist Services (legal basis: Article 6(1)(c) of the GDPR).
  • Pursuit of the legitimate interests of WYGODA TRAVEL, in particular for marketing and promotion of products and services offered by WYGODA TRAVEL, for archival, evidentiary, statistical, reporting purposes, for asserting claims or defending against them (legal basis: Article 6(1)(f) of the GDPR).
  • In other cases, personal data of Customers will be processed only based on the previously given consent, to the extent and for the purpose expressed in its content (legal basis: Article 6(1)(a), Article 9(2)(a) of the GDPR).

4. WYGODA TRAVEL will process the personal data of Customers for the period necessary to achieve the purposes for which they were collected, namely:

  • With regard to the performance of the concluded agreement with WYGODA TRAVEL for the duration of its validity, and thereafter for the period resulting from legal provisions or for the purposes of legitimate interests pursued by Wygoda Travel, including securing and asserting any claims.
  • With regard to the performance of a legal obligation incumbent on WYGODA TRAVEL, for the period and to the extent required by legal provisions.
  • In the event that personal data of Customers are processed for the purposes of legitimate interests pursued by WYGODA TRAVEL, as mentioned above, until these interests are fulfilled or until Customers object to such processing.
  • In the event that personal data of Customers are processed based on their consent, until such consent is withdrawn.

5. The personal data of Customers may be disclosed by WYGODA TRAVEL to the following categories of recipients:

  • Entities provided for in the Act on Tourist Services and entities authorized to do so under other legal provisions, including agents, carriers, hoteliers, restaurateurs, residents, insurers, resident pilots, transport companies, other travel agencies, to the extent that such information is necessary in connection with the performance of the contract for the provision of tourist services, courts and prosecutors, as well as other public authorities in connection with ongoing proceedings.
  • Entities processing personal data on behalf and for the benefit of WYGODA TRAVEL, including on the basis of the Act on Tourist Services – so-called processing entities.
  • Other entities cooperating with WYGODA TRAVEL, provided that such entity has the consent of Users to provide it with such data.

6. By signing up for the WYGODA TRAVEL newsletter or simply contacting us, you provide us with your personal data, and we guarantee that your data will remain confidential, secure, and will not be disclosed to any third parties without your explicit consent.

7. We entrust the processing of personal data only to verified and trusted entities providing services related to the processing of personal data.

8. We use Google Analytics analytical tools, which collect information about your visits to the website, such as the subpages you viewed, the time spent on the website, or transitions between individual subpages. For this purpose, cookies from Google LLC regarding the Google Analytics service are used.

9. We use Google AdWords tools to conduct remarketing campaigns. For this purpose, cookies from Google LLC regarding the Google AdWords service are used. Within the cookie settings, you can decide whether you consent to the use of such cookies in your case or not.

10. We use marketing tools, such as Facebook Pixel, to deliver personalized ads to you on Facebook. This involves the use of cookies from Facebook. Within the cookie settings, you can decide whether you consent to our use of the Facebook Pixel in your case or not.

11. We provide the option to use social functions, such as sharing content on social media platforms or subscribing to a social media profile. Using these functions may involve the use of cookies by administrators of social media platforms such as Facebook, Instagram, YouTube, Twitter, Google+, LinkedIn.

12. We use our own cookies for the proper functioning of the website.

13. In connection with the processing of data by WYGODA TRAVEL, Users have the following rights:

a) The right to access their personal data and obtain information, including on the categories of data and the purposes of their processing, as well as to obtain a copy of such data.

b) The right to rectify incorrect data and supplement missing data.

c) The right to request the erasure of data – the „right to be forgotten”, in the event that:

  • personal data are no longer necessary for the purposes for which they were collected or otherwise processed,
  • the data subject withdraws consent on which the processing is based and there is no other legal basis for the processing,
  • the data subject objects to the processing,
  • personal data have been processed unlawfully,
  • personal data must be erased to comply with a legal obligation.

d) The right to request the restriction of data processing, i.e., to suspend operations on data or not to delete data, in accordance with the application submitted in the event that:

  • the data subject questions the accuracy of the personal data,
  • the processing is unlawful, and the data subject opposes the erasure of the personal data and requests the restriction of their use instead,
  • WYGODA TRAVEL no longer needs the personal data for its purposes, but they are required by the data subject for the establishment, exercise, or defence of legal claims,
  • the data subject has objected to the processing – until it is determined whether the legitimate grounds of WYGODA TRAVEL override the objections of the data subject.

e)  The right to object to the processing of data, which means that regardless of the rights listed in this document, Users may object at any time to the processing of their personal data by WYGODA TRAVEL on the basis of WYGODA TRAVEL’s legitimate interest, including for direct marketing purposes. Such objection is binding on WYGODA TRAVEL, unless WYGODA TRAVEL demonstrates compelling legitimate grounds for the processing that override the interests, rights, and freedoms of the data subject or for the establishment, exercise, or defence of legal claims.

f)  The right to data portability, i.e., when data are processed automatically, Users have the right to request that their personal data be transmitted directly from WYGODA TRAVEL to another data controller, if technically feasible, where the processing is based on consent or contract.

g)  The right to withdraw consent to the processing of personal data at any time, without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal.

h)  The right to lodge a complaint with the President of the Personal Data Protection Office if Users believe that the processing of personal data is carried out in violation of the GDPR.

14. Providing personal data is voluntary but necessary for the provision of electronic services.

15. The administrator of personal data ensures appropriate technical and organizational measures ensuring the security of personal data provided by Users, in particular preventing unauthorized access to them or their processing in violation of the law, preventing their loss, damage, or destruction.

Users have the right to use them by printing selected pages and making temporary copies for purposes related to the choice of the offer presented by the Website operator.
